Acceptance of Terms

By accessing and using Thumbnail Suite, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Use constitute a legally binding agreement between you and Thumbnail Suite regarding your use of the service.

Service Description

Thumbnail Suite is an AI-powered platform that generates custom thumbnails for YouTube videos and other digital content. Our service includes:

  • AI thumbnail generation with various customization options
  • Face profile integration for personalized thumbnails
  • Background customization and editing tools
  • Multiple output options and refinement capabilities
  • Export functionality for various formats and sizes

User Accounts

To use our service, you must:

  • Create an account with accurate and complete information
  • Be at least 13 years old (or the age of majority in your jurisdiction)
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

Acceptable Use

You agree to use our service only for lawful purposes and in accordance with these Terms. You agree NOT to use the service:

  • To generate content that is illegal, harmful, abusive, or violates any rights of others
  • To create misleading, false, or defamatory content
  • To generate content that infringes on intellectual property rights
  • To harass, threaten, or intimidate any person
  • To create content that is obscene, pornographic, or inappropriate
  • To attempt to gain unauthorized access to our systems or other users' accounts
  • To use the service for any commercial purpose without proper authorization

Subscription and Payments

Subscription Plans

We offer various subscription plans with different features and usage limits:

  • Free plan with limited credits
  • Premium plans with increased usage and features
  • Enterprise plans for commercial use

Payment Terms

  • Subscription fees are charged in advance on a monthly or annual basis
  • All payments are processed securely through Stripe
  • Fees are non-refundable except as required by law
  • We reserve the right to change our pricing with 30 days notice

Refund Policy

We offer a limited refund policy under the following conditions:

  • 30-Day Money-Back Guarantee: New subscribers can request a full refund within 30 days of their first purchase
  • Service Downtime: Refunds may be provided for extended service outages
  • Billing Errors: We will correct and refund any billing errors

To request a refund, contact us at support@thumbnailsuite.com with your account details and reason for the refund request.

Note: Refunds are not available for credits that have been used to generate thumbnails.

Intellectual Property

Our Content

The service and its original content, features, and functionality are owned by Thumbnail Suite and are protected by international copyright, trademark, and other intellectual property laws.

User Content

You retain ownership of any content you upload to our service. However, by using our service, you grant us a limited license to:

  • Process and generate thumbnails based on your inputs
  • Store your content as necessary to provide the service
  • Use anonymized data to improve our AI models

Generated Content

You own the thumbnails generated by our AI based on your inputs. You may use these thumbnails for personal or commercial purposes, subject to these terms.

Service Availability

We strive to maintain high availability of our service, but we cannot guarantee uninterrupted access. Our service may be temporarily unavailable due to:

  • Scheduled maintenance and updates
  • Technical issues or system failures
  • Third-party service dependencies
  • High demand or traffic spikes

We will make reasonable efforts to provide notice of scheduled maintenance and to restore service as quickly as possible.

Account Termination

Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in your dashboard.

Termination by Us

We may terminate or suspend your account if:

  • You violate these Terms of Use
  • You engage in fraudulent or illegal activities
  • Your account remains inactive for an extended period
  • We discontinue the service

Upon termination, your access to the service will cease, and your account data will be deleted according to our data retention policy.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
  • WARRANTIES OF NON-INFRINGEMENT
  • WARRANTIES OF UNINTERRUPTED OR ERROR-FREE SERVICE
  • WARRANTIES OF ACCURACY OR COMPLETENESS OF CONTENT

We do not warrant that the service will meet your requirements or that the operation of the service will be uninterrupted or error-free.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THUMBNAIL SUITE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES
  • BUSINESS INTERRUPTION
  • LOSS OF GOODWILL OR REPUTATION
  • ANY OTHER COMMERCIAL DAMAGES OR LOSSES

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Thumbnail Suite operates, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the use of our service shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by:

  • Sending email notifications to registered users
  • Providing notice through our service interface
